Terms of Service

The rules governing use of the Fence Installers website, project information, estimate requests, communications, and third-party services.

Website terms, not a construction contract

These Terms govern this website and preliminary inquiry process. A signed proposal, purchase order, or construction agreement may contain separate project-specific terms that control if there is a conflict.

1. Acceptance and eligibility

These Terms of Service (“Terms”) govern your use of fenceinstallers.com and related pages, forms, calculators, and online services operated by Fence Installers, a division of American Precast Concrete Inc.. By using the site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.

You must be at least 18 years old and able to enter a binding agreement to submit a project request. If you act for a company, HOA, property owner, or other organization, you represent that you are authorized to act for it.

2. Website information, calculators, and estimates

Website content is general information, not engineering, architectural, legal, tax, insurance, permitting, fire-safety, or other professional advice. Product descriptions, dimensions, colors, specifications, availability, installation timelines, grant information, and examples may change and may not apply to every site or jurisdiction.

Online calculators, price ranges, and preliminary estimates are illustrative only. They are not offers, guarantees, or binding quotations. Final scope, price, schedule, design, warranty, permitting responsibilities, and payment terms are established only in a written project agreement signed by authorized parties after site review and applicable approvals.

You are responsible for confirming property ownership, boundary lines, easements, HOA rules, utility locations, permits, and site conditions unless a signed agreement expressly assigns a responsibility to us.

3. Estimate requests and communications

When you submit an estimate or contact form, you authorize Fence Installers and service providers acting for us to respond about your request by the channels you provide, including email, telephone, and text message. Message and data rates may apply. Consent to receive marketing communications is not a condition of purchasing goods or services where applicable law says it may not be required.

You may ask us to stop promotional email or text communications through the unsubscribe instructions, by replying STOP where supported, or by contacting us. We may still send non-promotional messages needed to answer an active request, administer a project, protect security, or comply with law.

4. Your submissions and responsibilities

You agree to provide accurate, current information and not impersonate another person. You represent that you have the right to provide any project address, document, photo, plan, comment, or other material you submit and that our use of it to evaluate and respond to your request will not violate another person’s rights.

You retain ownership of material you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, analyze, and share it with our personnel and service providers only as reasonably needed to operate the site, evaluate the request, perform an agreed project, maintain records, and comply with law. This license ends when the material is no longer needed, subject to backups, legal retention, and surviving project obligations.

5. Intellectual property

The site and its original text, design, code, graphics, product presentation, videos, photographs, and compilation are owned by or licensed to Fence Installers or its affiliates and are protected by applicable intellectual-property laws. Names and marks including ChiselStone™, WoodCrete®, BlockCrete®, StackStone™, SmoothStone™, and RusticBrick™ belong to their respective owners.

We grant you a limited, revocable, non-transferable right to access and use the site for personal or internal business evaluation. You may not copy, scrape, republish, sell, create derivative works from, or commercially exploit site content except with written permission or as allowed by law.

6. Acceptable use

You may not use the site to:

  • violate law, another person’s rights, or a contractual obligation;
  • submit false, fraudulent, threatening, abusive, discriminatory, or unlawful material;
  • introduce malware, probe vulnerabilities, bypass access controls, or interfere with availability;
  • use automated means to extract data at a rate or in a manner that burdens the service;
  • reverse engineer protected portions of the site except where law prohibits that restriction; or
  • use our names, marks, or content to misrepresent affiliation, endorsement, or project authority.

We may restrict or terminate access when reasonably necessary to protect the site, users, business operations, or legal compliance.

7. Third-party services and links

The site may use or link to third-party maps, analytics, advertising platforms, social networks, financing providers, grant resources, calculators, scheduling tools, and other services. We do not control their independent availability, content, security, eligibility criteria, approvals, or privacy practices. Your direct use of a third-party service is governed by its terms.

References to grants, financing, incentives, permitting pathways, or government programs are informational and do not guarantee eligibility, funding, approval, or timing.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, the site is provided “as is” and “as available.” We disclaim implied warranties regarding the site, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that site content is complete, current, error-free, uninterrupted, or suitable for a specific property or project.

To the maximum extent permitted by law, Fence Installers, American Precast Concrete Inc., and their personnel and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunity, arising from website use. Our aggregate liability for a website-only claim will not exceed the greater of $100 or the amount you paid us specifically for use of the website during the 12 months before the claim. These limitations do not apply where prohibited or to liability that cannot legally be limited.

Project-specific warranties, remedies, indemnities, and liability terms, if any, are governed by the signed project agreement.

9. Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law principles. Unless a signed project agreement provides otherwise, courts with jurisdiction in Los Angeles County, California will be the venue for disputes concerning these website Terms. Nothing here prevents either party from pursuing an eligible matter in small-claims court or seeking emergency injunctive relief.

Before filing a formal claim, we encourage you to contact us with a concise description and requested resolution so the parties can attempt a practical, good-faith resolution.

10. Changes, severability, and contact

We may revise these Terms by posting an updated version and changing the date above. Changes apply prospectively unless law permits otherwise. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. A delay in enforcement is not a waiver. These Terms and referenced policies are the entire agreement about website use, subject to any signed project agreement.
